1. Overview

Jobwala24 (“we,” “our,” or “us,” operating jobwala24.xyz, the “Site”) respects the intellectual property rights of others and expects our users and contributors to do the same. We respond to clear notices of alleged copyright infringement in accordance with the United States Digital Millennium Copyright Act (DMCA), the Indian Copyright Act, 1957, and the Information Technology Act, 2000 together with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

This policy explains how copyright owners (or their authorised agents) can notify us of allegedly infringing material on our Site, how we respond to such notices, how affected parties can submit a counter-notification, and the consequences for repeat infringers. It forms part of, and should be read together with, our Terms of Service.

2. Our Role as an Intermediary

Jobwala24 publishes original editorial content, aggregates publicly available job listings, and hosts limited user-generated content such as blog comments. Where content is provided by third parties or users, we act as an intermediary. We do not actively monitor all content for infringement, but we act promptly on valid notices. Acting on a notice does not constitute an admission of liability, nor a waiver of any defences or protections available to us under applicable law.

3. Before You Submit a Notice

Copyright does not protect every use of a work. Before sending a notice, please consider whether the use you are complaining about may be lawful—for example, because it is authorised by a licence, falls within “fair use” (US) or “fair dealing” (India), uses only non-copyrightable facts or ideas, or is otherwise permitted by law. Job titles, company names, salary figures, and short factual descriptions are generally not protected by copyright. If you are unsure whether material infringes your rights, we recommend that you seek independent legal advice. Submitting a notice has legal consequences (see Section 7).

4. Filing a Copyright Infringement Notice

If you believe in good faith that content available on or through our Site infringes a copyright you own or are authorised to represent, please send a written notice to our Designated Agent (Section 8) that includes all of the following:

  1. An identification of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
  2. An identification of the material that you claim is infringing and that you want removed, with enough detail—ideally the exact URL(s) on our Site—for us to locate it.
  3. Your full name, mailing address, telephone number, and email address.
  4. A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the copyright owner’s behalf.
  6. Your physical or electronic signature.

Incomplete notices may delay our response. Please send only one notice per submission and include all relevant URLs in that single notice where possible.

5. How We Respond

Upon receipt of a notice that substantially complies with Section 4, we will generally:

  • Acknowledge receipt of your notice, typically within 5 business days.
  • Review the notice for completeness and validity.
  • Promptly remove or disable access to the material identified as allegedly infringing where the notice is valid.
  • Take reasonable steps to notify the user or contributor who posted the material, where applicable, and provide them with a copy of the notice.
  • Where appropriate, retain a record of the notice and the action taken.

We may request additional information if a notice is unclear or incomplete, and we may decline to act on notices that are abusive, manifestly unfounded, or that do not meet the legal requirements.

6. Counter-Notification

If you are a user or contributor and you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to our Designated Agent containing all of the following:

  1. Your physical or electronic signature.
  2. An identification of the material that has been removed or disabled and the location at which it appeared before it was removed or disabled.
  3. A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full name, mailing address, and telephone number, together with a statement that you consent to the jurisdiction of the appropriate court and will accept service of process from the person who submitted the original notice (or their agent).

If we receive a valid counter-notification, we may restore the removed material in a reasonable time unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

7. Misrepresentations and Abuse

Please be aware that under applicable law, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. We take abuse of this process seriously and may decline to act on, or may report, notices that we reasonably believe are submitted in bad faith.

9. Repeat Infringer Policy

It is our policy, in appropriate circumstances and at our sole discretion, to disable or terminate access for users or contributors who are determined to be repeat infringers of the copyrights or other intellectual property rights of others. We may also remove content and take other action we consider appropriate, without prior notice.

10. Changes to This Policy

We may revise this DMCA Policy from time to time to reflect changes in law or our practices. Any changes will be effective upon posting on this page with an updated revision date. Your continued use of the Site after changes are posted constitutes acceptance of the revised policy.
